Atlantic Yards Eminent Domain Appeal Filed with Supreme Court

The 11 property owners and tenants fighting the usage of eminent domain to the troubled Atlantic Yards project have filed an attract the U. S. Supreme Court. The petition asks the Court to listen to the appeal from the eminent domain case, that was dismissed on February 1. Goldstein v. Pataki was originally filed in October 2006. The Atlantic Yards opponents conisder that hearing the case " provides the Court with a crucial chance to address the appropriate constitutional limits upon the government's power to seize private homes to the benefit of powerful real estate developers like Bruce Ratner. The group's legal argument is that there‘s merely a " pretext of the public purpose " to take land for Atlantic Yards via eminent domain in which the " actual purpose " is " to bestow a personal benefit. " The entire petition along with other paperwork are here. The Court only accepts a couple of cases every year, however the group plans to pursue the legal fight in state court when the Supreme Court doesn‘t accept the case or in the event that they lose. The state court process could delay any possible start from the project by a further 1-2 years.
